Legal Warranty - Online Purchase
If a fault is detected in the goods, the customer
has the right to demand from "Elite" CJSC to eliminate the fault
(free of charge repair or replacement of the goods, reduction of the price) or
to refuse to fulfill the contract.
Repair
and replacement of goods are the primary rights of the consumer. The Customer
has the right to demand from Elit Electronics CJSC free repair or replacement
of the goods, if this is impossible due to the nature of the goods or requires
disproportionate or unreasonably high costs.
The
goods must be repaired or replaced within a reasonable period of time (30
calendar days) so that the customer does not experience significant
delay, taking into account the nature of the goods and the purpose for which they
purchased the goods.
Free
repair or replacement of goods means that JSC Elit Electronics will pay all
costs (including postage, manpower and material costs) necessary to ensure that
the goods comply with the terms of the contract.
The
customer has the right to demand a reduction in the price of the goods or to
withdraw from the contract if one of the following conditions exists:
(a)
It is not possible to repair or replace the goods in accordance with the above;
b)
JSC Elit Electronics failed to repair or replace the goods within a reasonable
period of time, and the customer has lost interest in the fulfillment of the
contract;
c)
Repair or replacement of the product by JSC Elit Electronics will create a
significant delay for the customer.
In
case of termination of the contract, the customer has the right to demand
compensation for damages caused by non-fulfillment of the contract in
accordance with the rules established by the legislation of Georgia.
The
customer is not entitled to withdraw from the contract if the defect of the
goods is minor.
In
determining whether costs are disproportionate or unreasonably high, the
following conditions must be considered:
(a)
The price of the goods or services, subject to the conditions stipulated in the
contract;
(b)
The extent to which the goods or services do not conform to the conditions
specified in the contract;
c)
the alternative possibility of eliminating the fault of the goods without delay
for the customer.
The
goods are covered by both legal and commercial warranties and the customer is
entitled to benefit from the warranty in accordance with the terms of the
warranty.
If
the customer discovers a fault in the goods within 6 months of taking
possession of the goods, until proven otherwise, it shall be presumed that the
fault existed at the time of delivery of the goods, if this is possible based
on the nature of the goods or the nature of the fault. In this case, the burden
of proof is on the merchant. If the consumer discovers a fault in the goods
after 6 months of taking possession of the goods, the burden of proof that the
fault existed at the time of delivery of the goods lies with the
consumer. The customer has the right to exercise the rights under
Articles 17 (Consumer Rights) and 19 (Commercial Guarantee) of the Consumer
Rights Protection Act if the fault in the goods was discovered within 2 years
after the goods were handed over to him. The action does not apply to the
purchase of secondary goods. In the case of the purchase of such goods, the
seller's liability in the case defined above is subject to individual agreement
between the parties.
Warranty
service will not be provided and will be void if:
•
When replacing an item, if the customer has not handed the item to an
authorized service representative with a complete set, only the part of the
item that was handed over will be replaced.
•
The legal and commercial warranty period of the equipment has expired;
•
The user cannot present the warranty document and it is otherwise impossible to
identify the item;
•
Information in the warranty document has been deleted or altered and the item
cannot otherwise be identified.
•
The data on the goods sold has been deleted, changed, modified, the serial
number on the goods is not readable/removed and the goods cannot be identified
in any other way.
•
The damage is caused by the removal of a seal;
•
Fault is caused by physical impact and improper use;
•
damage is caused by lightning strike, penetration of foreign bodies and
liquids, violation of operating conditions and storage rules;
•
Damage caused by unstable, high or low power supply;
•
The complaint is caused by a malfunction of the electronic network, or the
mechanism is damaged through the fault of the customer;
•
installation or repair work carried out by other unauthorized persons resulting
in damage to the item;
•
The purchased equipment was used for commercial and business purposes.
Warranty service is not provided if the number of
pixels on your cell phone, tablet, camera, projector, monitor, TV is less than
the number of pixels specified by the manufacturer.
